Ok, I'm even embarrassed for Kilgore Campaign Manager Ken Hutcheson for this goof.  It appears that the Kilgore campaign is starting to develop cold (no, maybe frozen) feet about next Sunday's debate.  According to The Washington Post's Michael Shear:

Apparently shaken by Kilgore's less-than-stellar performance in the Fairfax County debate last month, the Kilgore campaign is seeking to make sure that Kaine's team can't use video from the debate in campaign ads. They had just such an agreement for the Fairfax Chamber of Commerce debate and the Bar Assocaition [sic] debate last July. This time, however, there is no such deal.

An email was sent forthwith to Kaine Campaign Communications Director, Mo Elleithee:

Hope all is well with you. When are you and Larry free to get together to sign a no-use agreement for the Oct. 9 debate? I would suggest using the one from the Fairfax Chamber debate. Are there any other issues we need to meet on? Thanks.

Good to hear from you. I hope all is well with you too.
As you know, there is no ?no-use agreement? for this debate, nor does the Kaine campaign have any interest in signing one. And, as you know, in our statement of August 10 in which we accepted the October 9 date, we stated that, ?We are also fully accepting the rules, logistics and format as determined by the debate sponsors, with no need for negotiations with the Kilgore campaign. We trust that they will do the same.?
As such, there really is no need to meet in advance of the debate. We look forward to seeing you on the 9th.

Oh, my...it seems that the word "whoops" is becoming an important part of the Kilgore lexicon. It also appears that Mr. Hutcheson doesn't quite "trust the people"--or at least Candidate Kilgore in this debate...
