H-1b and Exploitation of Foreign Workers Slammed: "Human Rights Abuse"

An article slamming the H-1b visa was released last week.  That isn't surprising as there are many articles slamming the H-1b visa.  What I find interesting is who is slamming it: Indian publications.

They correctly say that it harms both American citizens and guest workers.  They go even further coining it "human rights abuse".  Read for yourself: http://www.indiadail...

I also dug through the congressional record and this appears to be true!

What is worst, this amendment passed by unanimous voice vote...so either Webb has abandoned us or (more likely) Kennedy snowed his fellow Senators by hiding these massive increases in amendments which there was no time to read!

Some Democrat!  He gives a couple of bucks and screws over professional careers!

Today I made a rather horrifying discovery -- we could be just a few days
away from the McCain/Kennedy bill from becoming law. Congress is
fast-tracking legislation that contains massive increases in nonimmigrant
visas - as many as 400,000 the first year with 20% increases each year
afterwards. There is a bunch of other nasty surprises that I haven't even
looked at.

Please excuse the hasty nature of this newsletter. It is intended to give

all the details until more immigration experts can peer review its
contents. Speaking of immigration experts --- you might want to ask your
favorite immigration reform group why they haven't notified their activists

* The Senate passed the "Fair Minimum Wage Act of 2007" (S.2) by a 94-3
vote

* Senators Kerry and Kennedy introduced "Amendment 187", which contains
huge increases to H-1B and employer based green cards, and creates a new
nonimmigrant visa guest worker visa for unskilled workers called an H-5.
The H-5 visa is a pathway for amnesty. The amendment contains almost
identical wording to the Specter/McCain/Kennedy bill from last year's
comprehensive immigration bille (S. 2611) and the Skil Bill.

* Amendment 187 passed by a unanimous voice vote. I don't know if the votes
were recorded, but typically voice votes are off the record so the one's
who voted aren't held accountable.

* The House minimum wage bill hasn't passed yet, but that's where things
get very scary.

* Amendment 187 has been introduced to the House. This might mean we are
standing on the precipice of a major immigration disaster.

<<<<< CONCLUSION >>>>

It is highly likely that the House minimum wage bill will pass. I don't
know if amendment 187 has been approved by the House, but if it does get
approved there will be no way to stop it.

Thomas.gov and govtrack may update their information next week, which might
change these instructions.

The text can get very confusing, especially since so much of it is changes

Most of this will read like gobblygook, so to erase any doubts in your mind
that it's about H-1B, I reproduce this excerpt:

SEC. 1305. MARKET-BASED NUMERICAL LIMITATIONS.

refers to:

(g) Temporary workers and trainees; limitation on numbers
(1) The total number of aliens who may be issued visas or otherwise
provided nonimmigrant status during any fiscal year (beginning with fiscal
year 1992)
(A) under section 1101 (a)(15)(H)(i)(b) of this title, may not exceed
(i) 65,000 in each fiscal year before fiscal year 1999;
(ii) 115,000 in fiscal year 1999;
(iii) 115,000 in fiscal year 2000;

False Alarm, H-1B Visa increases NOT in H.R. 2 as amended (TurnVirginiaBlue - 2/5/2007 5:32:30 PM)
It's true, Kennedy did try to sneak into H.R. 2 H-1B Visa increases and much of McCain/Kennedy (S.2611 from 109th congress), but the above newsletter is in error, the Kennedy amendment is 180, and was tabled.

It's very easy to get confused in the www.thomas.gov
congressional record website.

The entire congressional record text is pulled up in trying to read amendments and the text references are not divided per amendment.

To make matters worse, the thomas.gov database has only temporary links when doing a search, hence one cannot email links to the specifics to obtain easy review by the public at large.

So, basically the place where amendment 180 stops and 187 begins was confused....because if one pulls up the congressional record text for amendment 187, one sees the text of amendment 180!

I hope that explanation is clear and honestly, we need a better congressional record implementation in my view so the public can review the activites of congress more easily.

and we don't have a full time lobbyist, on the hill, pouring over the last minute maneuvers...

but even in the lame duck, the move to put into the India Nuclear agreement H-1B Visa increases was very real, no one knew about it and as absurd as it is, Joe Biden blocked it, but ONLY because he thinks Democrats should get the "credit".

Credit?  Boy, is he out of touch, even the netroots, never mind the moderates and conservatives are becoming very hip to H-1B.

But, on that one, there was only 1 lobbyist, full time, who was aware of what was going on, even the lobbyists working for our issues missed it!

Anyway, I'd rather have a big scare than no one trying to make sure something isn't slipped in..

And all the Senators who got an earfull on the false alarm are now reminded of what to expect next time McCain or Kennedy try to sneak this anti-worker legislation in.  Today was us with no warning.

I just don't get Kennedy and his Democratic credentials.  Maybe he has been in the Senate too long and needs to retire.  He needs to remember who brought him to the dance - as I recall it wasn't IT corporations.  The fact that he is teaming up with McCain should send alarms off in his head.

Big business has a party - the Republicans.  Kennedy should remember that.  The party of big business is harming small businesses, American manufacturing, and American innovation.  They have weakened us for the past 15 years - rolling back labor protections and implementing crippling trade agreements.  He needs to watch the company he keeps.
