Does former Senator George Allen (R-VA) owe Siddharth $$?

Well, he doesn't really, as of now.  However, if Los Angeles attorney Gloria Allred has her way re: Michael Richards and his racist tirade, then Richards may just have to pay the men he insulted.

Richards, best known for his portrayal of the wacky neighbor Kramer in the mega-hit series GÇ£Seinfeld,GÇ¥ apologized for his behavior in an interview Monday night via satellite on David LettermanGÇÖs GÇ£Late Show.GÇ¥

"I got heckled and took it badly and went into a rage," he said, adding, "I am not a racist! That's what's so insane about this. For me to be on stage, and flip out and say this stuff, I'm deeply, deeply sorry."

Los Angeles attorney Gloria Allred, who is representing Doss and McBride, said she wants a retired judge to sit down with Richards and the two men to determine if the three-time Emmy winner should pay them for "the pain that he has inflicted on them as a result of his racist words."

"If our children took a  rock and threw it through the window of a next-door neighbor, we would say to that child, GÇÿGo to the neighbor, apologize directly to the neighbor and pay the cost of that window that you broke,'" Allred said. "We think itGÇÖs important that he follow his words with deeds."

So, my question is this:  why shouldn't George Allen pony up and make a finanial payment to Siddharth?  Did he NOT also make a racist comment IN PUBLIC and ON VIDEO this summer in Breaks?  And isn't what's good for the goose good for the gander as well?

EDIT:  I realize this didn't come across as sarcastic as I thought.  Obviously, I do not think either party deserves financial retribution for freedom of speech.  I am not that nuts.

Ah well-sorry.

She really is planning on suing Richards, though.  Keith Olbermann just reported.

UPDATE:  The WaPo picked up on the correlation as well...

Most states don't let someone sue for "emotional distress" based on words alone.  There must be accompanying injury.  So a plaintiff sues, for example,  for a broken wrist and the accompanying distress.  Some states make exceptions for emotional distress by bystanders if they are related, such as children who watch their parents being physically injured.  The idea is that words can only do so much harm, life is full of crap that we have to take (littlepunk, surf, NLS-just kidding about Ben), and we can't sue for every incident. I'm not sure how states like California treat hate speech or "fighting words." I guess Michael would have had to throw something in addition to the words he spewed.

however, your diary does cause me to consider this outlandish thought.

Politicians held personally responsible/liable for their actions/non-actions in office

(other than just losing their jobs we are all working so hard to achieve...).

One example, dead soldiers. Or Katrina victims, gay families, senior citizens trying to buy drugs, children left behind due to lack of funding, citizens without health care, "borrowing" social security with all us baby boomers in the pipeline, lobbyists lining their retirement pockets, nepotism,
"inset your favorite here ____________".

While I do realize it would probably bring things to a complete and total stand-still, it certainly is an interesting thought.

Word is rocketing around the balognasphere that President Bush, who ostensibly pardoned that turkey from Missouri, had it retransported back to the White House where he engaged in atavistic ritualisms with the cabinet before strangling the bird.  This picture was taken at the time of the faux pardoning, but one can see the evil glint in his eye.

I believe that the market will slap the hand of Richards - and result in much more of a financial loss than the courts would impose (assuming plaintiffs would win, which I doubt).

He did alot of damage to his reputation - tough to see how he comes back from this.  I suggest he check into rehab like Mel Gibson and Foley did and blame drugs and alcohol - or even the ministry if he gets desparate ;-)

The truth is that anger makes people say bad things.  He got angry, and said stupid things.  Does that mean he is racist?  I can't peer into his soul, but in some ways everyone is racist.  The question is to what degree.

The goal should be to recognize our own irrational behavior which in many cases has been programmed into us from childhood.  In my oppinion everyone is racist - and to some extent have racist behaviors programmed into them.  Good people are honest about this, and acknowledge that their racist tendencies are not a good thing - and overcome them. 

I suspect that with enough alcohol I can prove my theory that most people have racist tendencies.  I think you could devise a scientific way of testing the theory - that doesn't even involve alchohol. 

I think a great social experiment proving this was the taxi that picked up passengers (had a hidden camera - I think on A&E channle) and the driver was downright racist when he spoke.  His goal was to get others to "go racist".  Many did, some did not.  I'll bet with a little alcohol some of the ones who didn't fall for his ploy, would.  Does that make them bad?  I think it makes them human - and as humans we are far from perfect. 

Also, look at the Borat film - very interesting what people say when they feel it is socially acceptable.

They say the hardest job after a fireman is standup comedy.  Richards isn't a stand up so he probably didn't belong there and the fact that he was bombing didn't help.

He said things that would never be in our consciousness.  He went after the underdog.  Slaves were powerless and he mocked that.  Picnics were afternoon parties where the town enjoyed lynchings.  He ripped into that shame.

He showed a level of cruelty.  That is not entertainment. I hope he grows from this.
